Terms and Conditions

Registration

By registering, you accept Swimatic’s General Terms and Conditions as well as any course-specific booking policies.
Registration is conducted exclusively via online registration and is binding. A valid first and last name, as well as a complete postal address, are required for registration. The registration applies only to the selected course and is non-transferable.

Payment

By agreement, payment can be made by invoice or in cash on site. The full invoice amount must be paid within 14 days of the invoice date, but always before the course begins. If the invoice is not paid within the specified period, a first reminder with a CHF 15 reminder fee will follow. A second reminder will be sent 14 days later with an additional CHF 15 reminder fee.

Cancellation / Withdrawal

If a booked course cannot be attended, written cancellation must be sent to Swimatic. Non-payment or absence does not count as cancellation.

Cancellation fees (multi-session courses)*

If the cancellation occurs 14 to 8 calendar days before the course starts, 50% of the course fee must be paid.
If the cancellation occurs 7 or fewer calendar days before the course starts, 100% of the course fee must be paid.
In case of illness, upon presentation of a medical certificate, participation can be transferred to the next available course date.
The medical certificate must be sent to Swimatic within 3 days after the cancellation.
A refund of the course fee is not possible. Thank you for your understanding.

Cancellation fees (private lessons)**

If the cancellation occurs less than 48 hours before the course starts, 100% of the course fee must be paid.
If the cancellation occurs more than 48 hours before the course starts, no course fees will be charged.
In case of illness, upon presentation of a medical certificate, a refund for the missed lessons will be granted.
The medical certificate must be sent to Swimatic within 3 days after the cancellation.

Waiting time:
If participants arrive more than 15 minutes late at the meeting point, the course/lesson will be canceled and the full course fee must be paid.

Cancellation fees (swim holidays)***

If the cancellation occurs 43 or more calendar days before the arrival date, 0% of the course fee must be paid.
If the cancellation occurs 42 to 27 calendar days before the arrival date, 50% of the course fee must be paid.
If the cancellation occurs 26 to 0 calendar days before the arrival date, 100% of the course fee must be paid.

Cancellation (Training groups)****

Trainings missed due to holidays, military service, business trips, or similar reasons do not entitle participants to make-up sessions or course fee reductions.

Course Organization

For organizational reasons, individual courses/sessions may be rescheduled. Affected participants will be informed in time.

Insurance

Participants are responsible for their own insurance coverage (illness, accident, liability, cancellation, etc.). Swimatic assumes no liability for any kind of damage that may occur during the offered courses.

Photos / Videos

Swimatic reserves the right to publish photos and media content from courses, sessions, and training without the participants’ explicit consent. If a participant does not agree, they must notify Swimatic by email.

Google User Data & Google API Disclosure

Definition of the System

For the purposes of this policy, “Swimatic” or “the Swimatic platform” refers to the Swimatic booking, scheduling, and calendar synchronization system, including its Google Calendar integration and all internal software components used to operate these functions.

Scope of Google User Data Processing

The Swimatic platform may access Google user data only after explicit user consent is granted via Google OAuth authentication.
This access is limited to what is strictly necessary to provide booking and calendar synchronization functionality.

Categories of Google User Data Accessed

Depending on the user’s configuration, the Swimatic platform may access the following Google user data:

  • Google Calendar data (calendar lists, event availability, event titles, dates, and times)
  • Basic Google Account information (email address and account identifier)

The Swimatic platform does not access Google Contacts, Google Drive content, Gmail data, or other Google services.

Purpose of Processing

Google user data is processed exclusively for the following purposes:

  • Synchronization of bookings and availability with Google Calendar
  • Prevention of double bookings
  • Display of accurate availability information
  • Operational notifications related to appointments
  • Technical maintenance and system stability

Google user data is not used for advertising, marketing, profiling, or analytics beyond operational necessity.

Storage, Security & Protection Measures

Google user data is handled in accordance with GDPR principles of data minimization and security:

  • Data is stored only when technically required
  • All data transmissions are encrypted (HTTPS / TLS)
  • Access is restricted to authorized systems and personnel
  • Authentication tokens and credentials are securely managed
Third-Party Data Sharing

Google user data is not sold, rented, or shared with third parties.

Data may be processed by technical infrastructure providers acting solely as data processors on behalf ofSwimatic and bound by GDPR-compliant Data Processing Agreements.

Data Retention & Deletion

Google user data is retained only for as long as the user maintains an active Google account connection.

  • Upon disconnection or revocation of Google access, associated Google user data is deleted or anonymized
  • Users may request deletion at any time by contacting: info@swimatic.ch

Deletion requests are handled without undue delay and in accordance with GDPR requirements. 

User Rights & Control

Users may revoke Google account access at any time:

  • Through their Google Account security settings
  • Through Swimatic account settings, where available

Once access is revoked, synchronization with Google services ceases immediately.

GDPR & Consent Compliance

The processing of Google user data complies with:

  • Regulation (EU) 2016/679 (GDPR)
  • Consent Mode v2
  • CookieLawInfo / CookieYes consent implementation

Google APIs are activated only where valid consent is obtained and required.

SEO, Tracking & Analytics Coordination

The use of analytics and tracking services (e.g. Google Analytics 4 via Google Tag Manager) operates independently from the Swimatic platform’s Google API integrations. These services are used solely for technical analysis, reach measurement, and website optimization and do not process Google API user data. The collection and processing of analytics and tracking data occur only on the basis of valid user consent via the implemented consent management tool (CookieLawInfo / CookieYes) and are described separately in the Privacy Policy.

Jurisdiction

Swiss law applies to all legal relationships with Swimatic. Jurisdiction is Zurich.

Course Specific Booking Terms – Children’s Swimming Courses

Course Registration

  • Registration is done via the website and is binding.
  • Registrations are processed in the order in which they are received, subject to timely payment of the course fee.
  • Children currently enrolled in ongoing courses will be given priority for the following courses.
  • If a course has too few registrations, you will be contacted by Swimatic (Csoke Swimatic EF) and the course will either be postponed or canceled.
  • If a course is overbooked, a waiting list will be created. You will be informed if your child is placed on the waiting list.
  • Swimatic reserves the right to combine different levels (e.g., Frosch and Pinguin).
    In such cases, the group size will still be limited to a maximum of 9 participants.

Course Confirmation and Invoice

  • After your registration is received, you will receive a binding course confirmation and invoice by email.

Payment Terms

  • Course fees must be paid before the course begins, and no later than 14 days after the invoice has been sent.
  • This deadline must be observed.
  • Missed lessons do not entitle participants to a price reduction.

Course Cancellation

  • From 20 days before the course start date, the full course fee is due and will not be refunded.
  • If cancellation occurs earlier than 20 days before the course starts, 50% of the course fee will be refunded.

Safety and Responsibility

  • Parents or accompanying persons are fully responsible for their children immediately before and after the course session.
  • The swimming instructor is only responsible for the registered children during the course time.
  • Before and after the swimming lesson, the instructor assumes no responsibility for the children.
  • Supervision by the instructor ends once the children are dismissed.
  • Children must be showered and ready at the poolside 5 minutes before the course starts.

Absences

  • Missed lessons cannot be made up. Missed lessons due to extended illness or accident will not be refunded.

Pool Access

  • Entry to the indoor pool is free of charge for course participants with course registration. No additional fees apply.
  • The pool may only be used by current course participants.
  • Children may swim only during the assigned time slot. Swimming before or after this period is not permitted.

Hygiene

  • Thorough showering before the course is mandatory.
  • Food and drinks are prohibited throughout the pool and in the changing rooms.
  • Please ensure your child goes to the toilet before the course starts. This is not possible during the lesson.
  • Changing rooms/showers and the pool area may only be entered barefoot or with clean flip-flops.
  • For hygiene reasons, street shoes are strictly prohibited in changing rooms/showers and the pool area.
  • Strollers are not allowed in the changing rooms/showers or pool area.

Illness / Instructor Absence

  • In case of illness or absence of the instructor, a substitute instructor may step in without prior notice.

Photography and Filming

  • Photography and/or filming is strictly prohibited in the pool area.

Insurance and Liability

  • Swimatic accepts no liability for accidents involving course participants before or after the lesson. This especially applies to incidents occurring in the pool area outside of lesson times.
  • Insurance is the responsibility of the participants. Swimatic is not liable for damages, theft, loss of personal items, or accidents.

Force Majeure

  • No course fees will be refunded and no services provided for courses canceled due to force majeure (e.g., pool closure, technical issues, natural disasters, cleaning, etc.).
